§115.11 ZERO-TOLERANCE POLICY
The Zapata County Sheriff’s Office mandates zero tolerance towards all forms of sexual abuse and sexual harassment. Sexual abuse of an inmate and sexual harassment of an inmate are prohibited. It is the policy of the Zapata County Sheriff’s Office to comply with all standards set forth by PREA to prevent, respond, educate, screen and report sexual misconduct in its facility and those it holds contracts with for the confinement of its inmates. The Zapata County Sheriff’s Office will demonstrate compliance not merely by words and written policy, but through a zero-tolerance approach demonstrated through our actions to prevent, and the Department’s response to outcries of sexual assault.
§115.22 REFERRALS OF ALLEGATIONS FOR INVESTIGATION
ALLEGATION REFERRALS POLICY
It is the Zapata County Sheriff’s Office’s policy to ensure that allegations of sexual abuse or sexual harassment are referred for investigation to an agency with the legal authority to conduct criminal investigations, unless the allegation does not involve potentially criminal
behavior. The agency shall ensure that an administrative or criminal investigation is completed for all allegations of sexual abuse and sexual harassment. The Zapata County Sheriff’s Office shall document all such referrals.
Investigations of Allegations
The investigators assigned to the PREA Office shall conduct investigation for allegations of sexual abuse and sexual harassment.
All allegations regarding employee wrongdoing shall be forwarded to the office of the PREA Coordinator for investigation.
The PREA office shall ensure all reporting, follow-up, and PREA guidelines and standards are followed.
Publication of this Policy
The Zapata County Sheriff’s Office shall publish this policy on its website at (www.zapatacountysheriff.com) and make the policy available through other means.
